SUBJECT:Keep the Florida Quarter Horse Industry Alive

The Florida Legislature has the opportunity to clarify current law and keep the Florida quarter horse racing industry alive. Please help by immediately contacting the following members of the House Commerce Committee to tell them you want them to help keep the Florida Quarter Horse Racing industry alive by amending HB 7037 when it is heard in the House Commerce Committee on March 30, 2017 to include language in Florida law relating to pari-mutuel permits, cardroom licenses and slot machine licenses.

FQHRA’s position on current pari-mutuels is simple: just follow the law. If a horse track has a permit to run 40 days of horse races, then they should be required to run the appropriate number of live races and not be rewarded with the ability to have card rooms or slot machines without following the intent and spirit of the law.

Please email House Commerce Committee Chairman Pepi Diaz as well as members of the Commerce Committee and tell them you need their help to keep the quarter horse racing industry alive in Florida.

550.002(11) - Pari-mutuels (Permits)

“Full schedule of live racing or games” means, for a greyhound or jai alai permitholder, the conduct of a combination of at least 100 live evening or matinee performances during the preceding year; for a permitholder who has a converted permit or filed an application on or before June 1, 1990, for a converted permit, the conduct of a combination of at least 100 live evening and matinee wagering performances during either of the 2 preceding years; for a jai alai permitholder who does not operate slot machines in its pari-mutuel facility, who has conducted at least 100 live performances per year for at least 10 years after December 31, 1992, and whose handle on live jai alai games conducted at its pari-mutuel facility has been less than $4 million per state fiscal year for at least 2 consecutive years after June 30, 1992, the conduct of a combination of at least 40 live evening or matinee performances during the preceding year; for a jai alai permitholder who operates slot machines in its pari-mutuel facility, the conduct of a combination of at least 150 performances during the preceding year; for a harness permitholder, the conduct of at least 100 live regular wagering performances during the preceding year; for a quarter horse permitholder at its facility unless an alternative schedule of at least 20 live regular wagering performances is agreed upon by the permitholder and either the Florida Quarter Horse Racing Association or  the horsemen’s association representing the majority of the quarter horse owners and trainers at the facility and filed with the division along with its annual date application  in the event more than fifty percent of the total horse owners and trainers who are participating or have participated in quarter horse racing wish to designate an alternative representative organization, such organization, which shall not be affiliated with or under the control of the licensee, must be formed under guidelines approved by the Department and must be elected by a majority of the horsemen who are participating or have participated in quarter horse racing at Florida Quarter Horse race tracks in the state which are following AQHA racing guidelines, in the 2010-2011 fiscal year, the conduct of at least 20 regular wagering performances, in the 2011-2012 and 2012-2013 fiscal years, the conduct of at least 30 live regular wagering performances, and for every fiscal year after the 2012-2013 fiscal year, the conduct of at least 40 live regular wagering performances; for a quarter horse permitholder leasing another licensed racetrack, the conduct of 160 events at the leased facility; and for a thoroughbred permitholder, the conduct of at least 40 live regular wagering performances during the preceding year.

 

551.104(10)(a)2. - Slot Machines (Licenses)

No slot machine license or renewal thereof shall be issued to an applicant holding a permit under chapter 550 to conduct pari-mutuel wagering meets of quarter horse racing unless the applicant has on file with the division a binding written agreement between the applicant and the Florida Quarter Horse Racing Association or  the association representing a majority of the horse owners and trainers at the applicant’s eligible facility, governing the payment of purses on live quarter horse races conducted at the licensee’s pari-mutuel facility in the event more than fifty percent of the total horse owners and trainers who are participating or have participated in quarter horse racing wish to designate an alternative representative organization, such organization, which shall not be affiliated with or under the control of the licensee, must be formed under guidelines approved by the Department and must be elected by a majority of the horsemen who are participating or have participated in quarter horse racing at Florida Quarter Horse race tracks in the state which are following AQHA racing guidelines. Such agreement shall govern the payment of purses on live quarter horse races conducted at the licensee’s pari-mutuel facility and must be negotiated in an arm’s length transaction. The agreement governing purses may direct the payment of such purses from revenues generated by any wagering or gaming the applicant is authorized to conduct under Florida law. All purses shall be subject to the terms of chapter 550.


849.086(13)(d)3. – Cardrooms (licenses)
